Terms of Service

These Terms of Service ("Terms") govern your access to and use of Patina NFT Shop (the "Platform", "we", "us"). By creating an account, browsing the catalog, or placing an order, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. The service

Patina NFT Shop is a storefront for pre-minted non-fungible tokens (NFTs): every lot listed for sale is a real token that already exists on-chain, not a promise to mint one later. You pay in fiat currency by card, the same way you would in any online store. We do not execute any blockchain transaction on your behalf while you shop — after your payment is confirmed, a member of our team manually transfers the token to the wallet address you provide.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding contract to use the Platform. By placing an order, you confirm that this is the case and that you are not barred from using online payment or NFT services under the laws that apply to you.

3. Your account

You are responsible for keeping your login credentials confidential and for all activity that happens under your account. Tell us immediately if you suspect unauthorized use of your account.

4. Listings and pricing

We make reasonable efforts to keep lot descriptions, images, and prices accurate, but a lot may be sold, withdrawn, or corrected before your order is placed. The price you pay is the price shown at the moment your order is created; it is locked to that order and is not affected by later changes to the listing.

5. Orders and payment

Placing an order creates it with status pending. Once our payment processor confirms your payment, the order moves to paid. If the payment is declined or you cancel before payment is confirmed, the order is marked failed or cancelled and the lot immediately becomes available for other buyers again. Only one order can ever complete for a given lot, because each lot represents a single, unique token.

6. Delivery of the NFT

You are solely responsible for providing an accurate, valid wallet address (EVM-compatible, 0x-prefixed) for delivery. Once we send an NFT to the address you supplied, the transfer is recorded on a public blockchain and cannot be reversed — including if the address was incorrect, no longer under your control, or belongs to someone else. Double-check the address before confirming your order. After your order reaches status paid, we aim to complete delivery manually within a reasonable time; the order status changes to completed once the transaction is sent, and the transaction hash is made available on your account so you can verify it on the relevant block explorer.

7. Cancellations and refunds

You may cancel an order for free at any time before payment is confirmed. Once an order is marked paid, it is being prepared for on-chain delivery and can no longer be self-cancelled through your account; contact us if there is a problem with your order. Refund requests for paid orders are handled case by case and are subject to the terms of the Public Offer governing the specific sale.

8. Nature of NFTs — please read carefully

An NFT is a blockchain-based record of ownership of a unique token. Purchasing a lot on this Platform transfers ownership of that token to your wallet; it does not, by itself, transfer any copyright, trademark, or other intellectual property rights in the underlying artwork or media unless the lot description explicitly states otherwise. NFTs are a novel and volatile asset class: their value can fall as well as rise, and blockchain networks can be affected by congestion, fees, or outages outside our control. Nothing on this Platform is investment advice.

9. Prohibited use

You agree not to: use the Platform for any unlawful purpose; attempt to defraud us or other users (including chargebacks made in bad faith after successful delivery); interfere with or disrupt the Platform's operation; or attempt to bypass any security or access control.

10. Disclaimers

The Platform is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, regarding the Platform and the lots listed on it, including any warranty of merchantability, fitness for a particular purpose, or non-infringement.

11. Limitation of liability

To the fullest extent permitted by law, our total liability arising out of or relating to these Terms or your use of the Platform is limited to the amount you paid for the order giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, or for losses caused by an incorrect wallet address, third-party payment processor issues, or blockchain network conditions beyond our control.

12. Termination

We may suspend or terminate your account if we reasonably believe you have violated these Terms, engaged in fraud, or created risk or legal exposure for us or other users.

13. Governing law and disputes

These Terms are governed by the laws of [Governing Law / Jurisdiction to be specified before launch], without regard to its conflict-of-law principles. Any dispute arising from these Terms will be submitted to the courts, or other dispute-resolution forum, of that jurisdiction, unless mandatory consumer-protection law gives you the right to bring a claim elsewhere.

We may revise these Terms from time to time; the "last modified" date on this page reflects the latest version. Continuing to use the Platform after a revision takes effect means you accept the updated Terms.
